Citizen and Merchant Taylor of London and Dionise, his wife, one of the daughters of Anthony Burgis, deceased. John Page was seized in fee simple of premises in the town and county of Nottingham. He lawfully conveyed the same to Anthony Samon, Gent, one of his heirs, who conveyed the same to John Samon, the younger son of Anthony, who conveyed the same to Anthony Burgis, who shortly afterwards died, and the lands descended to Dionese and her sister Mary, now the wife of John Shore. Edmund Clay entered the premises and is rightfully owner of one half. The Shores sold their half to Richard and Robert Parker who, about two years ago, conveyed it to Clay. Their title is being challenged by Henry Ballard of Southwell, as descending to him from Edward Samons who is preventing the plaintiffs from seeing the deeds which would prove their title. They have asked him in a friendly manner to deliver them. Ask he be ordered to answer the charges.

About 33 years ago William Ballard, now deceased, the plaintiff's father, by several deeds, purchased, at several times, various messuages and tenements in the Town of Nottingham and in the County of Nottingham from Edward Samon Esq. William died about 14 years ago and the land descended to the defendant as his son and heir. Denies he has ever had deeds etc. relating to the property of the plaintiffs sometimes in the hands of John Page or Anthony Burgess. on 29 November 1619.4 He left a will on 4 November 1620 at Nottingham, Nottinghamshire, , England. He was buried on 14 January 1622 at Southwell, Nottinghamshire, , England.1 An Inquisition Port Mortem was held for his on 21 November 1622 at Nottingham, Nottinghamshire, , England; Held the demesne as of fee of a manor of Saxleby called Bassites manor. Henry Ballard died the fourteenth day of January 1622.
Thomas Ballard was son and next heir and was aged at the time of the death of the aforesaid Henry Ballard twenty one years and more.5 His estate was probated in 1623.

About four years ago he needed to borrow 300 or 400 pounds. He was acquainted with William Ballard the elder of the County of Nottingham, gentleman, and knowing him to be a man well monied and willing to lend money at interest. He asked Ballard for a loan of 400 pounds who, at first, seemed unwilling to lend it, but 'yet in kindness and goodwill, as he then pretended', he agreed to lend the plaintiff as much money as he requested in return for the security of a lease on the Manor of Haughton, which the plaintiff had purchased from Mr Doctor Tyndall, one of the prebends of the Collegiate Church of Southwell; the title of the Manor being in the gift of the Abbey and was sold to William Nevill Esq. by Edward VI by virtue of the Statute of Dissolutions in 1547, as well as a mortgage of certain lands lying in the Manor called the Vicar's lands. Loan from William Ballard was at the rate of 10 pounds per hundred on the profit of two meadow closes called the Swamp Closes for the term of one year, which closes are usually let for 10 pounds. By deed of 1 January 40 Elizabeth [1597/8], the plaintiff mortgaged the lands known as the Vicar's Lands and the lease of the Manor of Haughton. But not to William Ballard himself but to his son, William. But he only received 200 pounds. He was further prompted by William senior that he would lend more money, if needed, on the same security. Soon afterwards, the plaintiff asked for a further 100 pounds which Ballard agreed to lend but he was 'too greedy and covetous', that he forgot his previous promise and would have the plaintiff acknowledge a Statute Marchaunte or else the plaintiff would not have any further money, but such was the need of the plaintiff, and having no other lands to act as assurance, was enforced to agree to Ballard's demands and to acknowledge a statute before the Mayor of Nottingham. He received the 100 pounds. The plaintiff was unable to repay the total debt of 300 pounds when it became due because he could not sell the premises because he had been 'ensnared and entangled' by William Ballard Senior. The statute became forfeited and Ballard Junior tried to extend the statute, which the plaintiff endeavoured to avoid and they came to an agreement whereby the Junior Ballard would lend the plaintiff 100 more, and have three years for its redemption. At the end of 3 years, as before, the plaintiff would pay 500 in one payment. If the plaintiff failed to pay, then William Jnr would have the premises for 16 years, paying the plaintiff 50 pounds a year. In order not to weaken the former assurance [the original agreement] the new lease of 16 years was to be granted to John Marten of Denton, Lincs., yeoman. An Indenture of Covenant was to be made between the plaintiff and Ballard Jnr in the nature of a Defeasance to frustrate and make void all former assurances and also to reconvey the premises to the plaintiff on the payment of 500 pounds in one sum. Since the plaintiff could repay anytime within 3 years, and dispossess William Jnr of the premises, thus leaving him without a house for his wife and children and grazing for his cattle, therefore it was further agreed that the plaintiff would give William Jnr six months notice of the payment and the place of payment be the Manor House of Haughton, where William then lived. It was further agreed that William would not meddle with the expelling of any of the tenants, should only have the rent payable by the tenants and wood necessary for hedging and fencing only. He was also to have the 'Boones' and services of the tenants as he pretended that he could not occupy the manor without such help. Accuses William Jnr of not drawing up the agreement correctly but the plaintiff was, by the extremity of his position, his living of 100 pounds about to be taken from him, was driven to seal the agreement. He received the 100 pounds, which should have been in two payments, in ten payments instead, which was a great hindrance to him. William is now breaking the agreement by expelling some of the tenants and spoiling the woods with his cattle and suffered the houses to fall into ruin and decay and intends to plough up the meadow grounds because he knows that the plaintiff can only repay the debt by the sale of the whole premises or part of them.

William, gent of Southwell. Alice sole daughter and heir of John Martyn, late of East Allington in Lincolnshire, deceased. John held various lands in East Allington, West Allington and Connerbie in Lincs. Along with goods, chattels, stock and sums of money. Martyn was desirous that his daughter should marry William Ballard for her better advancement. To further this aim, Martyn by articles dated 18 November 32 Eliz I [1589] conveyed his lands to the plaintiffs and their heirs, after his death and that of his wife Isabell, both now deceased. He was also to pay William 6 score pounds at a time long since passed. If John died after Isabell (which he did), then the plaintiffs would have all his goods and chattels. The lands were conveyed to the plaintiffs, and afterwards to Martyn Ballard, one of their sons. John Martyn also delivered to the plaintiffs, goods and household stuffs to the value of 75-3-4d, as part of the 6 score pounds. Afterwards, Isabell died, but John survived and 'being very aged was deluded and drawen in by practises and persuasions' to marry Margaret Leake, sister of Richard Leake, although she was led to understand that she was not to expect any advancement or preferement, for that he had conveyed his lands and agreed to leave all his goods and chattels as aforesaid. At the time of the marriage, John had goods and chattels to the value of 200 pounds at the least which should have come to the plaintiffs. But the Leakes combined with Symon Buttree, clerk, to defraud the plaintiffs of the remainder of the 6 score pounds, the rest of the goods, which ought to be theirs and the lands. John Martyn died in April last and the goods, lands etc. should have come to the plaintiffs. The Leakes and Buttree have in their hands all the deeds, writings, bonds, agreements etc. relating to the estate of Martyn. They have entered the lands and embezzled the goods. Buttree has stated that he has a deed of gift of the goods, money and chattels made in Martyn's life time, which is to the great wrong and defrauding of the plaintiffs and against all right and equity. Martyn never made any deed to prevent the plaintiff's receiving the goods and if any was made, it was by 'sinister persuasions and allurements of the defendants', 'defrauding and abusing him in his sickness whereof he dyed…he not understanding in any sort…' The defendants will not allow the plaintiffs to have any sight of the goods left by Martyn or take an inventory of them nor do they have details of the deeds and other writings. Ask that Margaret Martyn, Richard Leake and Symon Buttree be subpoened to answer the bill.

He left a will on 28 May 1616; I will and bequeath unto my second sonne Edward Ballard all those my lands tenements and hereditaments whatsoever with all and singuler their appurtenances sett lyinge and beinge in the townes feildes and territoryes of Southwell the burgage of Southwell Easthorp Westhorp Upton and Halam in the county of Nottingham to have and to hold all the same landes tenementes and hereditaments with their appurtenances to the same Edward Ballard my second sonne and to his heirs forever.1 He died on 20 June 1616 at age 52.1 He bequeathed to Edward Ballard all his estates in Southwell, Upton, Hallam, Easthorpe and Westhorpe, Nottinghamshire. in their will probated on 20 June 1616.1 William Ballard was buried on 24 July 1616 at Nottingham, Nottinghamshire, , England.2 An Inquisition Port Mortem was held for his on 26 September 1616 at Newark upon Trent, Nottinghamshire, , England.1
