In the name of God Amen. I
William Ballard of the parish of St Andrews Holborn in the county of Middlesex
yeoman being of sound and perfect memory (praise be given to Almighty God for
the same) and knowing the uncertainty of this life on earth and being desirous
to settle things in order do make this my last will and testament in manner and
form following that is to say, first and principally I commend my soul to
Almighty God my creator assuredly believing that I shall receive full pardon and
free remission of my sins and to be saved by the previous death and merits of my
blessed saviour and redeemer Christ Jesus and my body to the earth from whence
it was taken. And whereas I having an interest and right to a messuage tenement
or <farme> situate in the city of Wells in the county of Somerset called
the Flower <Deanes> Farm. And of a messuage or tenement with the
appurtenances and of certain lands containing in the whole twenty two acres more
or less situate lying and being in the parish of Frindsbury in the county of
Kent have begun a suite in Chancery for the recovery of my just interest and
right in and to the said premises. And whereas I do owe unto my executor
hereafter named upon bond and judgement the principal sum of thirty pounds of
lawful money of England. Therefore by this my Will I give devise and bequeath
the said messuage or tenement in the City of Wells with the appurtenances and
the said messuage or tenement and lands in Frindsbury with their appurtenances
and all the estate right time and interest that is mine of in and to the same or
any part thereof either in Law or Equity and all other my real and personal
estate whatsoever unto my said executor hereafter named his heirs executors
administrators and assigns in trust to sell and dispose of the same and out of
the moneys thereby arising to pay or detain in the first place so much thereof
as will satisfy the money due upon the bond and judgement aforesaid and all
other costs charges and expenses whatsoever that my said executor or his heirs
administrators and assigns shall be put unto in recovering or getting in of all
or any my real or personal estate. And the overplus thereof my will is that my
said executor do pay out of the same to my cousin Henry Lewis what moneys he
hath or shall disburse for me or I owe unto him at the time of my death. And the
remainder thereof after my debts paid to be equally divided and paid to and
amongst my children and grandchildren that shall be then living and I do make
John Walton of the said parish of St Andrews Holborn in the said county of
Middlesex Chandler sole executor of this my last will and testament revoking all
former wills by me at any time heretofore made. In witness whereof I have to
this my last will and testament containing three sheets of paper set my hand to
the two first sheets thereof and my hand and seal to the last sheet thereof this
seventeenth day of March. One thousand six hundred and ninety two. William
Ballard signed sealed and published and declared by the said William Ballard to
be his last will and testament in the presence of us Will: Mariot Thos: Crosse,
Robert King.
