In the Name of God Amen - I William Ballard Dockhead Bermondsey in the county of Surrey Iron Monger being weak in body but of sound and disposing mind and memory and understanding (thanks be to God for the same) do hereby make and publish my last will and testament as follows first I desire that all my just debts and funeral and testamentary expenses may be duly paid and satisfied.  I give to devise and bequeath to my dearly beloved wife Mary Ballard all of my leasehold premises and all other my personal estate and effects whatsoever and wheresoever to hold the same to my said wife for the support of herself and the maintenance of our children for and during the term of her natural life if she should so long to continue my widow and I do hereby expressly direct and declare that immediately upon the death or second marriage of my said wife whichever may first happen my executors as hereinafter named or the survivor of them or the executors or administrators of such survivor do and shall sell and dispose of all and singular my said leasehold premises and all other my estate and effects whatsoever either by public sale or private contract and make and execute all proper conveyances and assurances thereof to the purchaser or purchasers of the same to such person or persons as he or she or they may direct and do and shall stand possessed of the money to arise thereby in trust to pay and divide the same unto and amongst all and every my children by my said wife who may be living at her decease or second marriage as the case may be share and share alike and I do hereby expressly authorized and empower my executors or the survivor of them or the executors or administrators of such survivor to apply and dispose of the whole or any part of that share of such of my children as may be infants either in clothing educating apprenticing or otherwise providing for them at such times and in such manner as my said executors all the survivor of them or the executors or administrators of such survivor shall think proper and that without being at all accountable or responsible or the same you to such children or any of them <????> full age and I do hereby declare that the receipts of my said executors for the purchase money arising from the said sales shall be good discharges to the purchasers who shall not be answerable or accountable for the nonapplication or misapplication thereof and I do hereby also declare that my said executors shall and may lawfully deduct and retain to themselves himself or herself all such costs charges damages and expenses as may be incurred or sustained in the execution of this my will and lastly I do hereby nominate constitute and appoint my said wife so long as she shall continue my widow and my friend William Jones Cooke executrix and executor of this my will hereby revoking all others by me heretofore made and declare this my last will and testament in witness whereof I have hereto set my hand and seal this fourth day of May 1835 William Ballard / seal / signed sealed and delivered by the said William Ballard the testator as and for his last will and testament in the presence of us and in his presence at his request and in the presence of each other have subscribed our names as witnesses hereto - William Hancock attorney at law Prospect Row Bermondsey Chas Hancock same place.

 

This is a codicil to the last will and testament of me William Ballard of Dockhead Bermondsey in the county of Surrey ironmonger bearing date the fourth day of May 1835 and which I desire may be annexed to and taken as part thereof whereas I have in my said will given and devised to my wife Mary Ballard all of my leasehold premises and all other my personal estate and effects whatsoever and wheresoever to hold to her for the purposes therein mentioned now I do hereby revoke and make void such requests so far only as relates to my leasehold house and premises being at number three Hickmans Folly Dockhead in the county of Surrey in the occupation of Mary Clayton and do hereby give devise and bequeathed the same unto my friend William Jones Cooke late of Salisbury Street Bermondsey Baker but now of Jamaica Row Bermondsey aforesaid Gentleman his executors and had administrators upon trust to receive the rents and profits thereof and to pay and apply the same in and towards the maintenance and education of my afflicted daughter Sarah Ballard in such a manner as the said William Jones Cooke and his executors or administrators may think most for her benefit until she shall attain the age of 21 years and upon her attaining that age I direct that the said William Jones Cook and his executors or administrators do and shall assign my said house and premises unto my said daughter Sarah Ballard to hold the same <????> her executors or administrators and assigns absolutely but if my said daughter shall happened to depart this life before she shall attain the said age of 21 years then I give devise and bequeath the said messuage or tenement unto my said wife to hold upon the trusts and for the purposes as in my said will is already declared of and concerning all of my leasehold premises and other effects in witness whereof I have hereto set my hand and seal this 19th day of April in the year of our lord 1837 William Ballard /seal/ signed sealed published and declared by the said William Ballard as and for a codicil to his said will in the presence of us who in his presence at his request and in the presence of each other have subscribed our names as witnesses hereto Garwood Takely Dockhead, William Hancock Prospect Row Bermondsey.

 

Proved at London with a Codicil 27th May 1837 before the Worshipful Thomas Blake Doctor of Laws and Surrogate by Mary Ballard widow the Relict during Widowhood and William Jones Cooke the executors to whom administration was granted having first been sworn duly to administer.
