In the name of God Amen. I Susanna Ballard of he City of New Sarum in the County of Wilts Spinster being sick and weak in body but of sound and prefect mind and memory (God be praised) revoking all former wills by me heretofore made do make and ordain this my last will and testament in manner and form following that is to say First I give and bequeath unto my loving brother John Ballard and Dorothy his wife the sum of ten pounds to buy them mourning Item I give and bequeath unto my loving brother Oliver Ballard and Martha his wife the like sum of ten pounds to buy them mourning Whereas my late brother in law Thomas Westbeere late husband of my sister Martha Webb was indebted unto Martha Ballard my late mother deceased in the sum of three hundred pounds And whereas the said Martha Webb by the name of Martha Westbeer widow in the lifetime of my said mother and by her consent did enter into one bond or obligation unto me of the penal sum of six hundred pounds with condition for payment of the said sum of three hundred pounds with interest at a certain day past which bond I do hereby declare was only taken for the payment of the interest of the said sum of three hundred pounds until John Westbeere son of the said Thomas Westbeere should attain his full age of one and twenty years Now my will and meaning is that my said brother John Ballard shall receive and take the moiety of all such interest money as now is or hereafter shall become due and payable on the said bond until my said nephew John Westbeere shall attain his full age of one and twenty years The whole sum of three hundred pounds of right being due and payable out of the real estate of the said Thomas Westbeere one moiety whereof doth of right belong unto my said brother John Ballard Item I give and bequeath unto my said brother Oliver Ballard the sum of fifty pounds of lawful English money to be paid unto him out of my personal estate at the end of eight years next after my decease Item I give and bequeath unto my nieces Martha Westbeere and Katherine Westbeere spinsters And to my nephew Gabriel Westbeere son and daughters of the said Thomas Westbeere and Martha his wife the sum of forty pounds apiece of like lawful English money And to my nephew William Webb son of my brother in law Nathaniel Webb gent and the said Martha his wife the like sum of forty pounds And my will and meaning is that the several sums of forty pounds hereinbefore given and bequeathed unto my said nephews and nieces severally shall be paid unto them by my executors hereinafter named as they shall severally attain their several ages of one and twenty years But in case my nephew John Westbeere shall depart this life before my said nephew Gabriel shall attain his age of one and twenty years so that the real estate of the said Thomas Westbeere shall come unto my said nephew Gabriel then I do hereby revoke the said legacy of forty pounds hereinbefore given unto the Gabriel And my will is that the said forty pounds herein before given shall be equally divided amongst my nieces Martha Catherine and my nephew William or such of them as shall be then living if more than one then living if but one the whole forty pounds to be paid to such one at the age of one and twenty years And further my will and meaning is that in case any or either of my said nephews or nieces vizt. Gabriel William Martha or Katherine shall depart this life before the age of one and twenty years then the legacy of such of them so dying shall be equally divided between the survivors of them at their several ages of one and twenty years if more than one living if but one the whole to be paid to such one at the age of one and twenty years But my will is that in case the real estate late of the said Thomas Westbeere shall by the death of the said John come unto the said Gabriel as aforesaid then I do hereby declare that case the said Gabriel shall not receive any benefit or profit by this my will All the rest and residue of my goods and chattels ready money bonds bills rights and credits whatsoever my debts legacies and funeral expenses being first paid and discharged I do hereby give and bequeath unto my said brother in law Nathaniel Webb and Martha his wife whom I do hereby make joint executors of this my last will and testament In witness whereof I have hereto set my hand and seal the three and twentieth day of March in the second year of the reign of our Sovereign William and Mary by the grace of God King and Queen of England etc Anno Domini One thousand six hundred eighty nine. Signed sealed published and declared by the above named Susanna Ballard to be her last will and testament in the presence of Mary Richards Tho Richards the mark of Mary Yarrington.

 

Probate granted in London to Nathaniel Webb 6 December 1693 with power reserved to Martha Webb his wife and joint executor.
