This is the last will and testament of me Sarah Ballard of Tenterden in the
County of Kent spinster made ordained published and declared the nine and
twentieth day of September in the seventh year of the reign of our Sovereign
Lord George by the grace of God of Great Britain France and Ireland King
defender of the faith etc
Anno domini 1720 Imprimis I give and
bequeath to my brother Joseph Ballard two pair
of sheets and two my brother Isaac Ballard two
pair of sheets to be taken by them respectively immediately after my decease.
Item all the rest of my linen I give unto the four children of my
sister Mary the wife of Joseph Day to be equally
distributed amongst them by my said two brothers Joseph and Isaac within one
month next after my decease. Item I
give to Sarah Ballard one of the daughters of my said
brother Isaac one Silver spoon and to Sarah Day
one of the daughters of my said sister Mary Day one other silver spoon to
be delivered to them respectively within one month next after my decease.
Item I given to my sister in law Rachel the wife
of my said brother Joseph Ballard my best stays and to
my sister in law Francis the wife of my brother Isaac
Ballard my black callamanrod quilted petticoat to be delivered to them
respectively within one month next after my decease. Item I give to my side
sister Mary Daly all the rest of my wearing apparel whatsoever linen woollen or
otherwise to be delivered to the within one month next after my decease. Item I
give all my pewter to all and every the children of my said brothers Joseph and
Isaac and sister Mary to be equally distributed amongst the said children by my
said brothers Joseph and Isaac within one month next after my decease. Item I
give and bequeath unto my said two brothers Joseph and Isaac the sum of 50
pounds on husband confidence nevertheless and to and for the several and
respective uses intents and purposes hereinafter particularly mentioned and
expressed that is to say upon husband confidence and to the intent and purpose
that they the said Joseph Ballard and Isaac Ballard or the survivor of them or
the executor or administrator of such survivor shall and do with all convenient
speed place the same out at interest on good security or good Securities and
shall and do yearly or oftener pay the interest or proceed thereof into the
proper hands of my said sister Mary Day for her own proper private and peculiar
use and benefit (and not into the hands of the said Joseph her husband) for and
during the term of her natural life and immediately after the decease of my said
sister Mary then on husband confidence and to the intent and purpose that they
the said Joseph Ballard and Isaac Ballard or the survivor of them or the
executor or administrator of such survivor shall and do pay or cause to be paid
the said principal sum of 50 pounds
unto and amongst all and every the children of my said sister Mary Day which
shall be living at the time of her decease in equal parts and proportions and my
will and mind is that the single rest and ???? Of my said sister Mary whether
she shall be ???? or sole shall from time to time be a good and sufficient
discharge and discharges to the said Joseph Ballard and Isaac Ballard and the
survivor of them and the executor and administrators of such survivor for all
such and so much money as they or either or any of them shall from time to time
pay to her by virtue and in pursuant of this my will. Provided always
nevertheless and my will and mind is if any loss or losses shall hereafter
happen of the said principal sum of 50 pounds or in part thereof the interest or
proceed thereof or of any part thereof unless it be through the wilful neglect
or default of the said Joseph Ballard and Isaac Ballard or the survivor of them
or the executor or administrator of such survivor that they the said Joseph
Ballard and Isaac Ballard or the survivor of them or the executor or
administrator of such survivor, shall not be charged or chargeable with or
anyway liable to make good such loss or losses provided also and my will and
mind further is that the said Joseph Ballard and Isaac Ballard and the survivor
of them or the executor or administrator of such survivor shall be charged and
chargeable with and accountable for such part or parts only of the said
principal sum of 50 pounds or of the interest or proceed thereof as they
shall respectively actually receive and no more and not the one for the other or
for the ??? Receipts disbursement miscarriage or defaults of the other.
Item all the rest and residue of my goods chattels ready money Securities
for money debts and all other my personal estate whatsoever and wheresoever (my
debts legacies funeral expenses and the charges of proving this my will and all
other charges and expenses incident thereto being thereout first paid and
discharged) I give and bequeath unto my said two brothers Joseph Ballard and
Isaac Ballard to their own proper peculiar and respective use and uses equally
to be divided between them. And I do hereby nominate constitute and appoint my
said two brothers Joseph Ballard and Isaac Ballard joint executors of this my
last will and testament. And lastly I do hereby revoke all former Wills by me
heretofore made in witness whereof I the said Sarah Ballard the testatrix to
this my last will and testament contained in these two sheets of paper together

first above written the mark of Sarah Ballard signed sealed published and
declared by the said Sarah Ballard the testatrix as and for her last will and
testament in the presence of us who have in her presence subscribed our names as
witnesses Thomas Theobald Mary Osborne Colep Cruttall.
