This is the last Will and Testament of me Samuel
Ballard of Nuneaton in the county of Warwick Gentleman.
First I will and a direct that all of my just debts and funeral and
testamentary charges and expenses shall be fully paid and satisfied I give and
bequeath to the three sons of my brother William Ballard
late of the city of London deceased the sum of 500 pounds each except
that out of the legacy bequeathed to Michael Ballard one
of such sons there shall be deducted the sum of 200 pounds which he
stands indebted to me and all interest that may be due for the same at the time
of my decease also I give and bequeath to all of the children of my
niece Mary Anne Gritton late the wife of a John Gritton the sum of 500
pounds to be equally divided between them also I give and bequeath to Mary
Godwin Hall wife of John Hall Gentleman of the Borough of Tamworth the sum of
300 pounds all which legacies I direct to be paid to the respective legatees at
the end of 12 calendar months next after my decease and subject to the payment
of my said debts and funeral and testamentary charges and expenses and the said
legacies I give and devise and bequeath all my messuages or tenements lands
hereditaments and real estate and also all other my personal estate and effects
whatsoever and wheresoever to William Ballard of the
city of Coventry Auctioneer son of my brother Michael Ballard deceased to
hold to him and his heirs executors or administrators and assigns forever
according to the respective tenures and qualities thereof and I constitute and
appoint my nephew the said William Ballard and the said John Hall executors of
this my will and revoking all former wills by me made do declare this to be my
last will and testament. In witness
whereof I have hereunto set my hand the 20th day of April in the year of our
lord one thousand eight hundred and forty one - Samuel Ballard signed by the
said Samuel Ballard as and for his last will and testament in the presence of us
present at the same time who at his request in his presence and in the presence
of each other have subscribed our names as witnesses hereto - Eliz Johnson -
John Webb
Proved at London 6th July, 1844 before the judge by the oaths of William Ballard the nephew and John Hall the executors to whom administration was granted having been first sworn by commission duly to administer.
