This is the Last Will and Testament of me Penelope Ballard heretofore of Walworth Place in the county of Surrey but now of Augusta Place Clapham Road in the same County of Surrey which I make in manner and form following Whereas in and by a certain Indenture bearing date the fourth day of February one thousand eight hundred and thirty one and made between me the said Penelope Ballard of the first part James Ballard Gentleman of the second part and Thomas Stead Carter Esquire James George Crabb Esquire and Robert Cousins Gentleman of the third part being the settlement made by me the said Penelope Ballard of certain funds in pursuance of the articles executed previously to my marriage with my late husband Mr. John Ballard deceased it is declared that the said Thomas Stead Carter James George Crabb and Robert Cousins and the survivors and survivor of them and the executors and administrators of such survivors did and should stand possessed of and interested in the sums of three thousand pounds consoles three per cent annuities and six thousand three hundred and forty four pounds eight shillings and five pence reduced three per cent annuities and the dividends and annual produce of the said trust funds to me the said Penelope Ballard and assigns during my life or authorize and empower <him> or them to receive the same and from and after my decease should stand possessed of and interested in the said trust funds and the dividends and annual produce thereof In trust for all the children or child of me the said Penelope Ballard as in the said Indenture is mentioned And it is hereby further declared that if there should not be any children or child of me the said Penelope Ballard or being such should die as therein mentioned then and in such case the said trustees should stand possessed of and interested in all the said trust monies stocks funds and securities or all such parts thereof as should not have been applied or disposed of under the trusts thereinbefore contained Upon such trusts and to and for such interest and purposes as I the said Penelope Ballard by any deed or deeds or by my last will and testament in writing to be signed sealed published and declared in the presence of and attested by two or more reliable witnesses should direct or appoint Now I the said Penelope Ballard having had no issue by my said late husband in pursuance and exercise of the power and authority given and reserved to me in and by the said Indenture of Settlement do hereby (in the event of my dying without issue or without any who shall live to become entitled to the said trust funds) direct and appoint give and bequeath the said trust monies stocks funds and securities as follows I give and bequeath the interest dividends and annual produce of the said sum of three thousand pounds consolidated three percent annuities part of the said sum of six thousand three hundred and forty four pounds eight shillings and ten pence like annuities unto my dear sister Eleanor Crabb Spinster for and during the term of her natural life independent of any husband with whom she may intermarry and I do hereby declare that her receipt alone not withstanding any coverture she may be under shall be a good and sufficient discharge for all such interest dividends and annual produce as she shall from time to time become entitled to and receive under and by virtue of this my Will And from and after the decease of my said sister Eleanor Crabb I give and bequeath the interest dividends and annual produce of the said three thousand pounds consolidated three percent annuities and also the interest dividends and annual produce of one thousand pounds reduced three per cent annuities (part of the said sum of six thousand pounds like annuities unto my cousin William Richardson Esquire a Captain in His Majesty's Royal Navy and Elizabeth his wife for and during the terms of their joint natural lives and the life of the survivor of them and from and after the death of such survivor I give and bequeath the said sum of three thousand pounds consolidated three per cent annuities and one thousand pounds reduced three per cent annuities unto all and every the children of my said cousin William Richardson to be equally divided among them and payable on their severally and respectively attaining the age of twenty one years and in case any one or more of the said children of my said cousin William Richardson shall die under the age of twenty one years then I give and bequeath the share or shares of him her or them so dying unto and equally among the survivors if more than one share and share alike and in case only one shall live to attain the said age then I give and bequeath the whole to such one or only surviving child his or her executors administrators and assigns I also give and bequeath after the decease of my said sister Eleanor the interest dividends and annual produce of three thousand pounds reduced three percent annuities (other part of the said sum of six thousand pounds life annuities) unto my cousin Joseph Richard Raggett Webb Esquire a Captain in His Majesty's Royal Navy for and during the term of his natural life and from and after his decease I give and bequeath the said three thousand pounds reduced three percent annuities unto all and every the children of him my said cousin Joseph Richard Raggett Webb to be equally divided among them and payable on their severally and respectively attaining the age of twenty one years And in case any one or more of the said children of my said cousin Joseph Richard Ragett Webb shall die under the age of twenty one years then I give and bequeath the share or shares of him her or tem so dying unto and equally among the survivors if more than one share share and share alike and in case only one shall live to attain that age then I give and bequeath the whole to such one or only surviving child his or her executors administrators and assigns I also give and bequeath after the decease of my said sister Eleanor the interest dividends and annual produce of one thousand pounds reduced three percent annuities (further part of the sum of six thousand pounds life annuities) unto my cousin Elizabeth Unwin wife of George Unwin Esquire and her husband the said George Grove Unwin for and during the term of their natural lives and the life of the survivor of them and from and after the decease of such survivor I give and bequeath the said sum of one thousand pounds reduced three per cent annuities unto all and every the children of my said cousin Elizabeth Unwin to be equally divided among them and payable on their severally and respectively attaining the age of twenty one years and in case any one or more of the said children of my said cousin Elizabeth Unwin shall die under the age of twenty one years then I give and bequeath the share or shares of him her or tem so dying unto and equally among the survivors if more than one share share and share alike and in case only one shall live to attain that age then I give and bequeath the whole to such one or only surviving child his or her executors administrators and assigns And as to one thousand pounds reduced three percent annuities (being the residue of the said sum of six thousand pounds life annuities) I give and bequeath (after the decease of my said sister Eleanor) the interest dividends and annual produce thereof unto my cousin Eleanor Richardson Spinster for and during the term of her natural life and from and after her decease I give and bequeath the interest dividends and annual produce of the said one thousand pounds reduced three percent annuities unto my said cousin Elizabeth Unwin and her husband the said George Grove Unwin for and during the terms of their joint natural lives and the life of the survivor of them and from and after the decease of such survivor I give and bequeath the said sum of one thousand pounds reduced three percent annuities unto all and every the children of my said cousin Elizabeth Unwin in the same proportions and payable at the same time and with the same benefit of survivorship among them as the said sum of one thousand pounds life annuities is hereinbefore given and bequeathed to them after the death of their father and mother and the survivor of them I give and bequeath the remainder of the said reduced three percent annuities being three hundred and forty four pounds eight shillings and ten pence of such annuities my ready money and all other my estate and effects whatsoever and wheresoever and whether in possession or reversion or over which I have any power of disposition unto my said sister Eleanor Crabb to and for her own use and benefit absolutely independent of any husband with whom she may intermarry and her receipt alone notwithstanding any coverture she may be under shall be a good and sufficient discharge for the same I hereby nominate constitute and appoint my said sister Eleanor Crabb sole executrix of this my last Will and Testament and hereby revoking all former and other wills by me at any time heretofore made I do declare this and this only to be and contain my last In witness whereof I have to this my last Will and Testament contained in five sheets of paper set my hand and seal that is to say my hand to the four previous sheets and my hand and seal to this the fifth and last sheet this sixth day of July in the yea of our Lord one thousand eight hundred and thirty five -- P. On the 2nd day of March 1855 Admon (with the will annexed) of the goods chattels and credits of Penelope Ballard formerly of Walworth Place in the County of Surrey afterwards of Augusta Place Clapham Road in the same County but late of No 11 Percy Place Clapham Road in the same County widow decd was granted to William Richardson Esquire the lawful cousin German and one of the next of kin having been first sworn duly to administer Eleanor Crabb Spinster the sister the sole Executrix and residuary legatee named in the will died in the lifetime of the said deceased.
