I Margaret Ballard widow of John Ballard late of Tenterden in the County of Kent deceased Do make and declare this my last will and Testament in manner following. Fist I give and bequeath to my son John Ballard the sum of Five pounds of good and lawful money of Great Britain to be paid to him by my executors within one year next after my decease. Also I give and bequeath to my son Edward Ballard] the like sum of Five pounds to be paid to him within one year next after my decease. Also I give and bequeath to my daughter Jane the wife of Thomas Stedman of Tenterden aforesaid all my wearing apparel. Also I give and bequeath to my said daughter Jane the sum of Ten pounds of good and lawful money of Great Britain to be paid by my executors in ten years at twenty shillings yearly the first payment to be made within one year next after my decease But my mind and will is that the ten pounds given to my daughter Jane shall not be paid to her in money but shall be laid out for her in wearing apparel yearly by my executors in such manner as she my said daughter shall please to direct and appoint till the whole ten pounds are so laid out if my said daughter Jane shall so long live and not otherwise. But I do not design that the above mentioned legacys shall be any addition to the like legacys given by my Husband in his will but only to enforce the payment of the same being informed that my said husband had no power or authority over the lands which he charged with the payment of the said legacys. Also I appoint my sons Stephens Ballard and Edmund Ballard to be executors of this my last will and testament. Also I give and devise all my lands and tenaments whatsoever and wheresoever to my said two sons Stephens Ballard and Edmund Ballard and their heirs in trust nevertheless that my said two sons shall sell all my said lands and tenaments as soon as they conveniently can for the best price they can get for the same and after the paymant of all my just debts legacys and funeral expenses and the charge of proving this my will out of the money arising from the sale of the said lands and tenaments and all other money of which I may die possessed shall be equally divided between my four sons John Stephens Edward and Edmund share and share alike or the representative of my said sons But if any one or more of my said sons shall refuse to submit to this my last will and testament or be wilfully the cause of any expense to his or their brother or brothers Then and in such case I do absolutely deprive such son or sons of any benefit from this my last will and testament and the share or shares of him or them so offending I do give and bequeath to such son or sons as are not guilty of such disobedience to this my last will and lastly I do hereby revoke and make void all former and other wills by me at any time heretofore made and declare this my last will and testament set my hand and seal this fourth day of August One Thousand seven hundred and sixty four.
