In the name of god amen.  I Margaret Ballard of 29 Duke Street in the parish of Saint George Bloomsbury in the county of Middlesex widow do publish and declare this to be my last will and testament hereby revoking all others hitherto by me made.  I give and bequeath to Mr. James Ballard of Barton Boat in the county of Nottingham the sum of £50.00 and to his brother Mr. William Ballard of Wells in Norfolk I give £10.00 I also give to the above named Mr. James Ballard my large Bible and reading desk I give and bequeath to my dear sister Elizabeth Ffoukes the sum of 100 pounds and to her daughter Lucy Edwards £50.00 I give her also two silver tablespoons marks ME to my worthy nephew Griffith's Ffoukes I give the sum of £50.00 and to his son William Cadwallader Ffoukes I give my watch made by <Desbois and Waccter> Gray's Inn Passage I give and bequeath to my friend Mrs. Hankin the sum of 100 I give her also my small Bible.  To Mr. George Hankin I have given up my large mahogany dining table and therefore desire him to take it from my apartment after my decease my silver pepper box sugar tongs two tablespoons silver milk jug and dessert spoon I give to my dear sister Ann Phillips I give to my worthy friend Mr. Philip Walton of Brighton my silver punch ladle as a token of remembrance I give and bequeath to my nephew Richard Ffoukes of Holborn the sum of £5.00 I requests that my dear friend and relative Mr. Edwards of Brookside will accept of five guineas for a ring as a token of my regard To my god daughter Ann Edwards I give the sum of £5.00 my crayon drawing on glass of my most honored Lady Wallingford I request the Ladies Knollys to accept of.  I request that my sister Hannah Phillips do select such of my wearing apparel as she pleases for her only use and benefit and to send the remainder to my niece Lucy Edwards and should my dear sister Ffoukes like any article I pray she may take what she likes best.  And as to all of the rest and residue and remainder of my estate and effects of what nature or kind so ever after payment of my debts and legacies and funeral and testamentary expenses I give and bequeath the same to my sister Ann Phillips and her daughter Mary Phillips to be equally divided between them share and share alike and I hereby appoint my said nephew Griffith Ffoukes and my friend Mr. George Hankin of Duke Street Bloomsbury to be executors of this my last will and testament and I request each of them will accept a mourning ring as such executors I also request the legacies by me given may be paid as soon as conveniently may be after my decease and the residue divided between my sister and niece accordingly in witness whereof I the said Margaret Ballard the testator have to this my last will and testament and to a duplicate hereof subscribed my hand and affixed my seal the 19th day of June in the year of our Lord 1830 Margaret Ballard signed sealed published and declared by the said Margaret Ballard the testatrix as and for her last will and testament in the presence of us who in her presence at her request and in the presence of each other have here unto subscribed our names as witnesses George Hankin - William Reriandet Bishop :  29 Duke Street Bloomsbury

 

This is a codicil to the last will and testament of me Margaret Ballard of number 29 Duke Street Bloomsbury in the county of Middlesex widow whereas by my last will and testament dated the 19th day of June 1830 I have bequeathed 100 pounds to my sister Elizabeth Ffoukes which legacy is now lapsed by reason of her death and whereas by my said will I have appointed Griffith Ffoukes and George Hankin executors thereof and whereof I by my said will  have bequeathed the sum of £50.00 to my niece Lucy Edwards which last mentioned legacy to Lucy Edwards I do hereby revoke and in lieu thereof I do hereby give and bequeath the sum of 100 pounds to the said the Griffith's Ffoukes and George Hankin or the executors and administrators upon trust to invest of the same in their or his own names or name in the Public Stocks or Funds or upon Government or Real Securities bearing interest to be from time to time at their or his sold direction altered and transposed for others of the like nature and to pay the dividend interest and yearly income therefrom arising to my niece Lucy Edwards the wife of Joseph Edwards during her natural life for her separate use and benefit and upon her sole receipt of the same may not be subject to the debts control or engagements of her said husband and after her decease upon trust to pay and transfer the same trusts monies funds or premises to the child if only one and if more than one of them unto and equally amongst all the children of my said niece if such child or children as the case may be shall then have attained the age of 21 years but in case any of them shall be under that age at the deceased of my said niece then upon trust to apply the principle or yearly income of the said trust monies and premises for and towards the maintenance advancement and education or otherwise for the benefit of such one or more of the said children respectively as the said Griffith's Ffoukes and George Hankin shall in their discretion from time to time think proper and advantageous and either equally or otherwise but my said executors and trustees are not to be accountable for any losses except such as happen through their own wilful neglect or default nor for any inequality in the distribution of the trust moneys or funds or premises for as I have made them acquainted with my intentions I am confident they will fulfil them accordingly and I hereby bequeath the sum of £50.00 unto the said Griffith Ffoukes for his own <   > and benefit in addition to what I have given him in and by my said last will and I hereby confirm my said will in all other respects in witness whereof I the said Margaret Ballard the testatrix have to this codicil set my hand and seal this 30th day of December 1831 M.Ballard signed sealed published and declared by the said Margaret Ballard the testatrix as and for a codicil to her last will and testament in the presence of us who in the presence of her request and in the presence of each other have subscribed our names as witnesses Matthew Hankin : William Bishop 29 Duke Street Bloomsbury

 

This is a codicil to the last will and testament of me Margaret Ballard of 29 Duke Street in the parish of Saint George Bloomsbury in the county of Middlesex widow whereas in and by my said last will and testament which bears dates the 19th day of June 1830 I have given the sum of £50.00 to Mr. James Ballard of Barton in the county of Nottingham and also given to him my large Bible and reading desk and whereas the said James Ballard hath lately separated this life whereby the said legacies or bequests have become lapsed or void now I do hereby give the said Bible and reading desk to James Ballard of Barton aforesaid the son of the said James Ballard lately deceased and as to the said legacy or sum of £50.00 I dispose of the same as follows viz.  I give to the three children of the said James Ballard deceased whose names are believed to be James Elizabeth and Ann Rebecca the sum of £10.00 each with liberty before my executors or the survivor of them to retain the sum as given to any of such children as may be minors until they attain the age or ages of 21 years or to advance the same in marriage or for the advancement in the world at any time during such minority or minorities without being accountable to any person for so doing I give to Mrs. Catherine Richardson wife of Thomas Richardson of San?yaire in the county of Derby the sum of £10.00 payable as soon as conveniently may be after my deceased and as to the rest and remainder of the said sum of £50.00 (being £10.00) I desire the same to sink into the residue of my personal estate in favour of my sister Phillips and her daughter and I hereby confirm of my said will in every respect in which the same is not affected by the death of the said James Ballard and by the contents of this and a former codicil to the said will in witness where of I have to this my codicil and to a duplicate thereof set my hand and seal the 23rd day of November in the year of our Lord 1832 Margaret Ballard signed and sealed published and declared by the said testatrix as and for a codicil to the last will and testament in the presence of us who in her presence at her request and in the presence of each other have here unto subscribe to an names as witnesses thereto Matthew Hankin ; William Bishop

 

This is a further codicil to the will of Margaret Ballard of 29 Duke Street Bloomsbury widow whereas I have by a former codicil revoked a bequests to the widow of the late Mr. James Ballard and given the £10.00 so revoked unto Mrs. Catherine Richardson now upon consideration I wish my original intentions to be carried into effect by my executors paying the £10.00 to Mr. James Ballard widow I give to my niece Mrs. Ffoukes the wife of Mr. Griffith Ffoukes £10.00 as a token of my regard and I also give to Mrs. Elizabeth Ann Jones Mr. Richard Morris Ffoukes Edward Ffoukes and William Ffoukes four children of the said Griffith Ffoukes the sum of £10.00 each for their very kind attention to me at all times and I confirm my will and codicil in all respects so far as the same is not affected by the further codicil in witness whereof I hereunto set my hand and seal this 16th day of February 1834 Margaret Ballard witness to the signature of Mrs. Margaret Ballard as and for a codicil to the last will and testament William Bishop : Hannah Bishop

 

In the goods of Margaret Ballard widow deceased

Appeared personally Griffith Ffoukes of Little Russell Street Covent Garden in the county of Middlesex and made an oath that he is the nephew of Margaret Ballard late of Duke Street in the parish of Saint George Bloomsbury in the county of Middlesex widow deceased and the surviving executor named in the last will and testament of the said deceased now hereunto annexed and bearing date the 19th day of June in the year 1830 and the deponent having reviewed the words "and a former" written between the fifth and sixth lines of the second side of the second codicil to the said will the said codicil bearing date the 29th day of November 1832 hereunto annexed he made an oath that the said recited words were written by George Hankin now deceased and the other executor named in the said will in the presence of the deponent previous to the execution of the said codicil by the said deceased and this deponent referring to the following clause in the said codicil to the said will bearing date the 16th day of February 1834 to whit " whereas I have by a former codicil revoked a bequest to the widow of the late Mr. James Ballard and given the £10.00 so revoked to Mrs. Catherine Richardson" he further made an oath that he has made diligent search among the papers in the possession of the said deceased and enquiry of persons acquainted with the affairs of the said deceased and has not found any codicils as alluded to buy the said clause nor any testamentary paper whatsoever save the said will and three codicils hereunto annexed Griffith's Ffoukes on the 29th day of May 1838 the said Griffith Ffoukes was duly sworn to the truth of this affidavit before me WC Curtis Surrogate FC Dyke Notary Public

 

Proved at London with three codicils 1st of June, 1838 before the worshipful John Danbury Dr. of laws and Surrogate by the oath of Griffith Ffoukes the nephew the surviving executor to whom administration was granted having been first sworn duly to administer.
