This is the last Will and Testament of me John Ballard
of Moore Street in the parish of Birmingham in the county of Warwick Gentleman.
I direct that all of my just debts and funeral expenses and the costs of
proving and executing this my will be fully paid and satisfied by my executors
hereinafter named. I give and
bequeath the following specific legacies namely unto Mrs Elizabeth Sheldon of
Moore Street Birmingham aforesaid widow with whom I present ly reside the sum of
£40.00 and to Mr. John Dollman of <Belmans> Row in the parish of Aston
near Birmingham aforesaid gentleman the sum of £19.00 19 shillings to be paid
to them respectively as soon as convenient after my decease unto the Treasurer
for the time being of the Birmingham General Hospital the sum of ten pounds to
be a applied for the charitable purposes of that institution unto the treasurer
for the time being of the Deaf and Dumb Institution of Edgbaston near Birmingham
the sum of £10.00 to be applied for the charitable purposes of that institution
unto the treasurer for the time being of the Birmingham Blue Coat Charity School
the sum of £10.00 to be applied for the purposes of that institution unto the
treasurer for the time being of the Birmingham Dispensary the sum of £10.00 to
be applied for the charitable purposes of that institution and I direct the said
legacies to the above mentioned charitable institutions be paid out of such
parts of my personal estate as the law permits to be appropriated by will to
charitable purposes and the receipts of the respective treasurers shall be good
discharges to my executors also I give and bequeath to my friends Henry Jones
Dollman of Birmingham factor and Charles Dollman of Birmingham wine merchant the
sum of £50.00 apiece for their own use and benefit and as to all the rest and
residue of my estate and effects of whatsoever nature kind or quality it may be
of which I shall die possessed or in any manner <???> <????> to or
over which I may have any disposing power at the time of my decease and not
having before otherwise disposed of I give devise and bequeath the same unto my
nephew Thomas Harman of Birmingham schoolmaster son of my Sister Nancy Harman
his heirs executors or administrators and assigns for his and there own absolute
use and benefit and I hereby direct and declare that in case my said nephew or
other of my said friends Henry Jones Dollman and Charles Dollman or the said
Elizabeth Sheldon or the said John Dollman shall die in my lifetime that then
and in such case the said legacy or property Whether specific or residuary
hereinbefore bequeath to such of them so deceased shall be paid and applied to
his or her executors or administrators to be disposed of as part of his or her
personal estate and I give and bequeath the same accordingly and I do hereby
declare that my executors shall not to be answerable for any more moneys than
they shall severally actually receive by virtue of this my will nor for any loss
that may happen to my property so as such loss happen without their wilful
default or neglect and that one of them shall not be answerable for other of
them but each of them for his own acts and defaults only and also that it shall
be lawful for them to reimburse themselves and each other all such expenses as
they or either of them may be put to in the execution of this my will and I do
hereby nominate constitute and appoint the said Henry Jones Dollman and Charles
Dollman executors of this my will hereby revoking all former wills by me at any
time heretofore made. In witness
where of I the said testator have to this my last will and testament set my hand
this seventh day of September one thousand eight hundred and forty four - John
Ballard his mark signed by the said testator John Ballard and declared to be his
last will and testament in the presence of us present at the same time who at
his request in his presence and in the presence of each other have here to
subscribed an names as witnesses William Huntley clerk to Mr. Henry <????>

Proved at London 7 November, 1844 before the Judge by the oath of Henry Jones Dollman and Charles Dollman the executors to whom administration was granted they're having been first sworn by commission duly to administer.
