This is the last will and testament of me John Ballard of Harbridge in the county of Southampton Yeoman First I give and bequeath unto my friends Anthony Mist of Moyles Court Farm in the parish of Allingham in the county of Southampton aforesaid gentleman and Joseph Payne of Rookford in the same parish of Allingham yeoman and to the survivor of them his executors and administrators all of my worldly money securities for money live and dead stocks in <Sp??sba???ry> and all other my personal estate and effects whatsoever and where so ever which I shall be possessed of at the time of my decease  in trust for the purposes hereinafter mentioned (that is to say) to my dear wife the sum of £40.00 to be paid to her out of the first money that shall come to the hands of my said trustees or the survivor of them his executors or admons also I give and bequeath unto my said wife one annuity or yearly sum of £30.00 to be paid to her by half yearly payments from the day of my decease for and during the term of her natural life clear and separate and in addition to her widow's estate which she will be entitled unto from and after my decease in my copyhold estate at north Ashley in the said county with its rights members and appurtenances and I do hereby charge and make chargeable all and singular my said personal estate and effects with and for the payment of the said annuity also I give and bequeath to my son Thomas Ballard the sum of £20.00 also I give and bequeath to Sarah daughter of my said son Thomas Ballard the sum of £10.00 also I give and bequeath to Mary Elizabeth and Ann Ballard the other children of my said son Thomas Ballard the sum of £20.00 each also I give and bequeath to my son George Ballard the sum of 100 pounds or such part of my life and dead stock or implements in husbandry to the value thereof which ever he shall prefer to be valued by my said trustees or any person they shall appoint also I give and bequeath to my son Benjamin Ballard the sum of 150 pounds also I give and bequeath to my daughter Betty Ballard the sum of 130 pounds also I give and bequeath to my daughter Ann Ballard the sum of 200 pounds also I give and bequeath to my daughter Virtue Ballard the sum of 200 pounds also I give and bequeath to my daughter Martha wife of Thomas Sims the sum of 130 pounds also I give and bequeath to Henry Ballard son of my late son John Ballard deceased the sum of £40.00 also I give and bequeath to John Ballard the other son of my said late son John Ballard the sum of £30.00 and my will and desire is that the several and respective legacies to my said children and grandchildren shall be paid to each of them as shall have attained the age of 21 years and to such of them as shall have attained the said age of 21 years at the time of my decease as soon as may be convenient to my said trustees not exceeding the space of one year after my decease provision being first made for the payment of the said annuity of £30.00 to my said wife and I hereby empower my said trustees to dispose of my said personal estate and effects in such manner as they shall judge most advisable and the money arising therefrom to place out on government or other good securities as they shall think proper for the purposes aforesaid and I desire an inventory and appraisement of my said live and dead stock and implements in husbandry may be taken as soon as convenient after my decease and all the rest and residue of my said a personal estate and effects from and after the deceased of my said wife I hereby give and bequeath unto and amongst such of my said children as shall be living at the time of the decease of my said wife equally share and share alike and lastly I do hereby nominate constitute and appoint my dear wife Mary Ballard and the aforesaid Arthur Mist and Joseph Payne joint executrix and executors of this my last will and testament in witness whereof I have hereunto set my hand and seal this 13th day of June in the year of our lord 1799 - John Ballard signed sealed published and declared by the said John Ballard the testator as and to be his last will and testament in the presence of us as witnesses John Philpott  Ro Strickland

 

This is a codicil to my foregoing last will and testament and which I direct shall be taken as part thereof and I do hereby give and bequeath unto my sister Joan Ballard the sum of £10.00 to be paid to her as soon after my decease as she may have occasion for the same In witness whereof I have here unto set my hand this first day of September 1800 - John Ballard - witness Joseph Hayter - Ro Strickland

 

This will was proved at London with the codicil the 19th day of September in the year of our lord 1801 before the right hon. Sir William Wynne knight Dr. Of laws master keeper or commissary of the Prerogative Court of Canterbury lawfully constituted by the oaths of Mary Ballard widow the relict of the deceased Arthur Mist and Joseph Pain otherwise Payne the executors named in the will.
