This is the last will and testament and me John Ballard of South Street Grosvenor Square in the county of Middlesex stable keeper which I make in manner following that is to say first I desire that all my just debts funeral expenses and the expenses of proving this my will may be duly paid and satisfied by my executrix and executor hereinafter named so soon as conveniently may be after my decease and I give and bequeath unto my dear wife Sarah Elizabeth Ballard all my household furniture plate linen china books wearing apparel and all other my personal property of what nature or kind soever including all and every my present and future interest in this stables Court houses and buildings in South Street aforesaid and in Chapel Street Grosvenor Square aforesaid together with my interest in the stock in trade and the business carried on in the premises which I am entitled to on the decease of my mother Anne Ballard under and by virtue of the will of my late father John Ballard deceased to and for her own soul and absolute use and benefit and whereas I am possessed in fee of a messuage or tenements and barns together with 12 acres of land more or less situate lying and being at Readers Bridge in the parish of Tenterden in the county of Kent one moiety of which I became entitled to under the will of my great-uncle Thomas Ballard late of High Halden in the said county of Kent gentleman deceased and the other moiety thereof I became entitled to under the will of my said late father John I do hereby give devise and bequeath the same premises with the appurtenances unto my brother Thomas Ballard of Chapel Street aforesaid stable keeper and to his heirs and assigns for ever upon condition nonetheless that he pay to my said wife her executors or administrators within twelve months next after my decease the sum of £300 of lawful money of Great Britain to and for her own use and benefit which I leave to her in lieu of any dower that she may claim at Common Law or in equity in the said premises. But in case my said brother Thomas Ballard shall neglect or decline to pay to my said wife the said sum of £300 within the time limited then I give devise and bequeath the said messuage or tenements barn land and premises with the appurtenances unto my said dear wife her heirs and assigns to and for her and their own use and benefit for ever and I do hereby nominate constitute and appoint my said wife Sarah Elizabeth Ballard executrix and my said brother Thomas Ballard executor of this my will and it is my will that any said executrix and executor shall not be answerable or accountable for any more monies than they shall respectively actually receive or liable for any loss that may happen to my said estate unless by their own wilful neglect or default or for the acts deeds or receipts of the other of them but each of them for their own acts deeds and receipts only and lastly I do hereby revoke and void all former and void all will and wills by me at anytime heretofore made and declare this only to be and contain my last will and testament. In witness whereof I have hereunto set my hand and seal this 23rd day of July in the year of our Lord 1814 – John Ballard signed sealed and declared by the said testator John Ballard as and for his last will and testament in the presence of us who in his presence at his request and in the presence of each other have subscribed our names as witnesses thereto – John Butcher South Audley Street Grosvenor Square Peter Worsley South Audley Street aforesaid George Hodgson <D???> Charles Street St James.

 

Proved at London 7th October 1814 before the worshipful Samuel Rush Meyrick Doctor of laws and surrogate by the oaths of Sarah Elizabeth Ballard widow the relict one of the executors to whom administration was granted being first sworn duly to administer power reserved to Thomas Ballard the brother and other executor.
