This is the last will and testament of me John Ballard of Chapel Street Grosvenor Square in the county of Middlesex stables keeper which I make in manner and form following (that is to say) first I desire that all my just debts funeral expenses and expenses of proving this my will may be duly paid and satisfied by my executors hereafter named. And whereas I sometime since purchased of Mr William Norris of <Whitsom> (Wittersham?) in the county of Kent the undivided moiety of and in a freehold messuage or tenements lands and hereditaments with the appurtenances situate at Readers Bridge in the parish of Tenterden in the county of Kent then enter now in the occupation of Edward Ballard the other undivided moiety or whereof I am entitled to for my life under the will of my late uncle Thomas Ballard deceased now I do hereby give and devise the said undivided moiety so purchased by me as aforesaid of Kent in the said messuages or tenements and lands and hereditaments with their appurtenances unto my son John Ballard his heirs and assigns for ever and I give and devise unto my dear wife Anne Ballard all that my undivided fourth part or share offer and in all that messuage or tenement lands hereditaments and premises with the appurtenances called <Smalled> Ferry situate lying and being in the said parish of Tenterden & county of Kent to hold to my said wife for and during the term of her natural life and from and immediately after her decease then I give and devise the said last so mentioned premises unto my said son John Ballard and to his heirs and assigns for ever. And whereas I have for many years last passed carried on the business of a stable keeper at and in my leasehold messuages or tenements stable yard coach houses stables and premises situate in South Street and Chapel Street Grosvenor Square aforesaid now I do hereby give and bequeath all and singular my said leasehold messuages or tenements stable yards coach houses stables and premises together also with all my stock in trade has a stable keeper and household furniture which I shall be possessed of at the time of my decease unto Bartholomew Arlot of Old Bond Street in the parish of St George Hanover Square in the county of Middlesex stable keeper and John Hall of Hamilton Street in the said parish and county stable keeper and to their executors and administrators to hold the said messuages or tenements stable yards and premises unto the said Bartholomew Arlot and John Hall and the survivor of them and to the executors and administrators of such survivor of for and during the term or terms of years estate and interest which I shall have to come therein at the time of my decease and together also with all my stock in trade and household furniture upon trust to permit and suffer my dear wife Anne Ballard to hold and enjoy the same at for and during the term of her natural life for the purpose of carrying on the said business of a stable keeper which I direct to be continued with having no doubt that my two sons John Ballard and Thomas Ballard will assist her therein to the utmost of their power for and during her natural life. And from and immediately after her decease then upon trust to convey and transfer my said leasehold premises unto my said two sons John Ballard and Thomas Ballard as tenants in common and not as joints tenants to and for their own use and benefit subject nevertheless and charged and chargeable as hereinafter mentioned. And in order to enable my said dear wife Anne Ballard to keep up of my stock in trade and carry on the said business and to pay my debts funeral expenses and legacies and subject thereto I do hereby give and bequeath unto her all the book and other debts that shall be due to me at the time of my decease and as to my stock in trade and household furniture I do hereby direct my trustees within twelve months after the decease of my said wife either by mortgage of my said leasehold premises or by such other means as they shall think fit to raise such sum of money as shall be equal to the value of one full moiety or half part of my said stock in trade and household furniture and pay the same unto and between my two daughters Sarah Ballard and Ann Ballard of or otherwise well and sufficiently cover the payment of the same to the good liking of my said daughters to and for their own use and or benefit and for ascertaining the same I do direct an inventory to be taken and appraisement thereof made at my decease and signed by my said trustees. And as to the remaining part of my said stock in trade and household furniture upon trust to deliver and transfer the same unto my said two sons John Ballard and Thomas Ballard to and for their own use and benefit. And I do here in give and bequeath unto the said Bartholomew Arlot and John Hall my trustees and executors hereafter named the sum of £10 each for a ring. And all the rest residue and remainder of my estate and effects whatsoever and wheresoever and of what nature or kind soever I give and bequeath unto my said dear wife to and for her own use and benefit. And I do declare that what I have hereinbefore given devised and bequeathed to my said wife shall be in lieu and in bar of any right of dower or thirds that she might be entitled unto out of my real estate and I do hereby nominate constitute and appoint my said dear wife Anne Ballard and the said Bartholomew Arlot and John Hall executrix and executors of this my will and the said Bartholomew Arlot and John Hall trustees for the purposes hereinbefore mentioned. And it is my will and I do hereby declare that my said executrix and executors shall not be answerable for any more monies than they shall actually receive or liable for any loss that may happen to my said estate unless by their own wilful neglect or default or be liable for the acts and deeds or receipts of the other of them but only of them for her and his own acts deeds and receipts only and that they shall and may retain and reimburse themselves all such reasonable costs charges and expenses as they may be put to in the due execution of the trusts of this my will and lastly I do hereby revoke and make void all former and other will and wills my be at anytime heretofore made and do declare this only to be and to contain my last will and testament. In witness whereof the said John Ballard have to this my last will and testament contained on three sheets of paper to the two first sheets thereof set my hand and to the last hand and seal the 20th day of November 1802 – John Ballard signed sealed and published and declared by the said testator as and for his last will and testament in the presence of us in the in his presence at his request and in the presence of each other have subscribed our names as witnesses hereto George Hodgson Jr Charles Street St James Sq Henry Dance Doctor George <?????> Hodgson <??????>.

 

This will was proved at London on the 30th day of May in the year of our Lord 1804 before the worshipful CharlesCoote Doctor of laws surrogate of the right Honourable Sir William Wynne knight Doctor of laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted and by the oaths of Anne Ballard widow the relict of the deceased Bartholomew Arlot and John Hall the executors named in the said will to whom administration of all and singular the goods chattels and credits of the deceased was granted they having been first sworn duly to administer.
