I John Ballard being sound of mind but labouring under Great bodily weakness and which I am very much inclined to believe will terminate in my death do make this my last will and testament in manner following I give and bequeath to my dearly beloved and most affectionate wife Penelope Ballard all my property of whatever description it may be except one hundred pounds sterling which I give to my dear sister Jane Ballard for her sole benefit after the decease of my dear wife I leave that part of my property which she will then be in possession of to my two nephews James and John to be equally divided between them I appoint my Brother James Ballard to act as my executor and to see that all my lawful debts are paid and my outstanding debt collected. I hereby appoint my wife Penelope Ballard point executrix with my Brother Jas Ballard -- John Ballard -- witness James Hughes -- Septimus Littlewood

 

I wish my faithful servant James Hughes to be allowed some thing per annum for his life -- John  July 6th /

 

In the Goods of John Ballard deceased /

Appeared Personally Septimus Littlewood of Beckford Row Walworth in the county of Surrey Surgeon and John Blakeman of Pleasant Row East Lane Walworth in the same County Gentleman and made oath that they knew and were well acquainted with John Ballard formerly of Walworth but late of Camberwell in the County of Surrey deceased as also with his manner and character of hand writing and subscription having often seen him write and write and subscribe his name and having now viewed and inspected the paper writing hereunto annexed purporting to be and contain the last will and testament with two Codicils of the said deceased the said will bearing date the twenty seventh day of June last and the last of the said Codicils being in the following words "I wish my faithful servant James Hughes to be allowed something per Annum for his life" and subscribed "John Ballard" and is written immediately under the first Codicil in the second side of the half sheet of paper in which the said will is written they say that they verily and in their conscience believe the said last Codicil as also the subscription thereto to be the proper hand writing and subscription of the said John Ballard deceased Septimus Littlewood -- John Blakeman -- on the second day of December 1822 the said Septimus Littlewood and John Blakeman were duly sworn to the truth of this affidavit before me John Daubeny Surrte prest Wm Geering Clarkson <prip>.

 

Proved at London with two codicils 2nd December 1822 before the worshipful Charles Coote Doctor of Laws and Surrogate by the oaths of Penelope Ballard Widow the Relict the Executrix named in the first Codicil and James Ballard the Brother the Executor named in the will to whom admon was granted being first sworn duly to administer.
