Inventory of the personal estate wheresoever situated of George Alexander Ballard late of the Madras civil service sometime residing at 8 Earls Court Square South Kensington London or afterwards resided at Philipburn, Selkirk and died there upon the 8th day of August 1892.

Philipburn, Selkirk, 27th day of September 1892 years. In presence of Robert James land Esquire one of her majesties justices of the piece of the county of Selkirk appeared Julia Mary Ballard presently residing at Phillip turn near Selkirk executrix of the deceased George Alexander Ballard sometime of the Madras civil service who resided at Philipburn aforesaid and being solemnly sworn and examined depones that she and George Alexander Ballard deceased at Philipburn aforesaid domiciled in Scotland upon the 8th day of August 1892 years and left a widow and lawful issue surviving that the deponent has entered upon the possession and management of the deceased’s estate as sole executrix nominated by him in his last will and testament executed by him the upon the 19th day of May 1877 and codicils there to dated 25th July 1881 and 26 October 1885 all registered in the books of Council and session in the sixteenth day of August 1892 and extract whereof is now exhibited and signed by the deponent and the said Robert James Lang of this date as relative hereto.

 

That the deponent does not know of any testamentary settlement or writing relative to the disposal of the deceased personal estate or effects or any part …

 

Extract registered last will and testament of GA Ballard

 

At Selkirk the twelfth day of October 1892 years in presence of David Boyle Hope Esquire Advocate Sheriff of Roxburgh Berwick and Selkirk compared Scott Moncrieff and Trail WS Edinburgh who gave in the last will and testament underwritten desiring the same might be recorded in the court books of the Commissariat at Selkirk in the forms of law which desire the said Sheriff finding to be reasonable he ordained of the same to be done accordingly whereof the <?????> follows. At Edinburgh the sixteenth day of August 1892 the deed hereinafter engrossed was presented for registration in the books of the Lords of Council and session for preservation and is registered in the said books as follows: --

 

This is the last will and testament of me George Alexander Ballard of the Madras civil service presently residing at eight Earls Court Square South Kensington London . After my just debts and funeral and testamentary expenses have been paid I give bequeath and devise £1000 sterling to my dearly beloved wife Julia Mary Ballard, £500 to my dear sister Susan Jane Ballard, £100 to my dear brother John Archibald Ballard, £50 to my good cousin Francis Langun. Each of the above legacies to take effect only in the event of the particular legatee surviving me but if my above said brother does not survive me then I desire £100 to be divided equally amongst such of his children as survive both of us and I bequeath and devise the whole and residue and remainder of my property real and personal whether in possession or reversion to my dearly beloved wife Julia Mary Ballard to be enjoyed by her in life rent for her benefit and for our children and to be divided equally in fee or absolutely amongst any children then surviving at the time of their mother’s death but if any child died during their mothers life leaving issue such issue shall if it survived my wife take the parents share. Provided always that should any of the said children of ours enter on a profession or marry during their mothers life time and with her consent and approval it shall be in her power at her option to bestow it in fee to the son or daughter so entering a professional or marrying such portion of the estate not exceeding an equal share calculated on the number of children than alive as to the said Julia Mary Ballard shall seem fit. In case of such a recipient shall have no claim to share in the residue of the estate under any circumstances. I particularly desire that my funeral shall be conducted in the simplest manner possible. I pray my wife to select a few suitable articles from my personal effects and give them to such of my relatives and friends and she knows I would like to have a small souvenir and who would care to receive one. I appoint my wife Julia Mary Ballard executrix to my estate and I trust the guardians named to the marriage settlement made on the occasion of my wife’s marriage with me to act with her as guardians to our children. In witness whereof the said George Alexander Ballard have hereunto set my hand this nineteenth day of May 1877. I George Alexander Ballard of the Madras civil service (retired) presently residing at eight Earls Court Square South Kensington London declare this to be a codicil of my last will and testament dated the 19th of May 1877 whereas certain of the persons named tutors and curators of my children in the settlement executed prior to the marriage made between my wife Julia Mary Ballard are desirous of being relieved from the guardianship trusted and imposed on them by my aforesaid will now I hereby declare that the guardians of my infant children shall be my said wife and such only of the tutors and curators named in the aforesaid contract of marriage as shall be living at the time of my death or may be the legal guardians entitled to act under such settlement. In witness whereof I the said George Alexander Ballard have hereunto set my hand is 25th day of July 1881. I George Alexander Ballard late of the Madras civil service formerly residing at eight Earls Court Square South Kensington London and presently residing at Philipburn, Selkirk Scotland declare this to be a second codicil to my Will dated the 19th of May 1877. Whereas the sum of £350 the same or a little more or less has been applied for or on account of fees subscription etc payable in connection with my son Archibald Anderson Ballard taking out indentures as apprentice according to the regulations of the society of writers to Her Majesty’s Signet for the said sons behoof now I hereby declare that the said sum of £350 be considered an advance and that this advance and any other sum hereafter paid by me or after my decease by my wife Julia Mary Ballard on behoof of any child or children of ours and declared in writing by my said wife or myself to be an advance under the codicil shall be taken according to the amount thereof in full or part satisfaction of such child or children’s share of my residuary estate as bequeathed by mine above said will. And except as aforesaid I confirm my said will and the first codicil thereto. In witness whereof the said George Alexander Ballard have hereto set my hand this 28th day of October 1885 (signed) GA Ballard signed published and declared by the said George Alexander Ballard the testator as and for a codicil to his last will …
