This is the last will and testament of me Ann Ballard of Chapel Street in the parish of St George Hanover Square in the county of Middlesex widow which I make in manner following (that is to say) first I desire that all my just debts funeral expenses the expense of proving this my will readily be duly paid and satisfied as soon as may be after my decease. I give and bequeath all my wearing apparel all such household linen china glass and plate has I shall be entitled to dispose of at my decease unto and to be equally divided between my two daughters Sarah Ballard and Ann Ballard to and for their own use and benefit and I also give and bequeath unto each of my said daughters the sum off £50 to be paid them within three months next after my decease and whereas the value of my stock in trade of a stable keeper is considerably larger and when it was left me by my late husband John Ballard deceased now I do hereby desire that an account and apportionment may be made thereof as soon as conveniently may be after my decease and what shall appear to be the value thereof over and above what my said husbands stock was surprised at on his decease and which after my death be disposed of by his will and together with the residue and remainder of my estate and effects monies debts and securities for money not by this my will or by any codicil or codicils <?????> a <?????> a to give bequeath and dispose of IDS I may be divided into for equal parts and shares and one fourth part thereof I give and bequeath unto my son John Ballard and one other fourth part thereof unto my son Thomas Ballard to and for their respective use and benefit and I give and bequeath unto John Hall of Grove Place stable keeper and my said sons John Ballard and Thomas Ballard a Bond or obligation made and given to me by James <Dawfield> of Harley Street Cavendish Square Esquire for servicing the payment of £500 at interest also the said principal sum of £500 together or leave the remaining to forth of the surplus value of my stock in trade hand and residue of my said estate and effects monies and debts and securities upon the trusts <?????> pounds to transfer this <?????> intents and purposes hereinafter contained (that is to say) upon trust to lay out and invest <?????> the said sum of £500 house the said last mentioned to fourth part of the surplus and residue of my estate and effects as the same shall be got in <?????> even and <?????> or <?????> of the public stocks and funds of this key and in the names of the said John Hall John Ballard and Thomas Ballard or the survivor of them or the executors or administrators of such survivor enter the dividend and any of proceeds arising therefrom shall be from time to time by me <?????> <?????> shall <?????> he is <?????> pay unto the proper <?????> daughter Sarah Ballard and Ann Ballard in equal shares and proportions during their natural lives to and for her and their own unsold lying and <?????> and benefit and not to the subject or liable in any amount to the plank of engagements power control all plank of any husbands within either of them may intermarry and their respective receipt or receipts alone to be a sufficient discharge of discharges for the said executors either of my said daughters shall happen to die without bearing issue lawfully begotten then upon trust to pay and the interest dividends and annual proceeds of the said one fourth part of the said funds and annuities of mine deceased daughter <?????> enter into the proper hands of the survivor of my said daughter for and during the term of her natural life in such manner enter a <?????> only conditions as I have heretofore directed to her original share to be paid and <?????> either or both of my said daughters shall happen to die leaving issue lawfully begotten then upon trust to pay and divide the principle of the share of such deceased daughter all daughters leaving issue as aforesaid unto and amongst all and every her or their respective children on their respectively obtaining the age of 21 years of the interest and dividends there on in the meantime to be paid and applied to and for the respective maintenance education and bringing up in equal proportions and in case only one of my said daughters shall have issue then the whole of this said trust fund and annuities to be paid and divided unto and among the children of such daughter believing issue as aforesaid <?????> <?????> <?????> last <?????> in <?????> to the <?????> thereof and <?????> <?????> of my said daughters will happen to die without leaving issue then upon trust to and for the sole benefit of my said two sons John Ballard and Thomas Ballard and that the said two forces parts or they share of the surplus of then to <?????> of my said estate and effects of the funds and annuities wearing the same shall be <?????> ending vested shall be paid off transferred unto my said two sons equally share and share alike for their own use and benefit of the in case either of my said sons shall die <?????> of life time or the survivor of them my said daughters leaving issue lawfully begotten of them that then <?????> of he and so dying and the interest and dividends shall go and be paid unto and for the use of the children of such <?????> sons the <?????> <?????> as easy hereinbefore contained in respect to the children of my said daughters and in case either of my said sons shall happen to die without leaving issue as aforesaid then that the share of him so dying shall go to the survivor of them my said sons to and for his own use and benefit of and in case above my said sons shall happen to die in the life time of the survivor of then my said daughters lying and leaving issue then upon trust for the use and benefit of such persons and persons and in <?????> manner and form as the survivor of then my said daughters leaving no issue shall <?????> and by her last will and testament in writing executed by her into the presence of and attested my two or more credible witnesses (and which will she shall have power to make before that purpose) is give bequeath and appoint assign <?????> <?????> default of such give the bequest or appointment then for the use and benefit of <?????> of <?????> and loyal representatives provided always and it is my will and I do and hereby direct thanked <?????> a <?????> said sum of £500 or any part thereof shall be paid to offer in my life time then their parts of such part thereof as shall have been paid off shall be <?????> paid out of the residue of my estate and effects I have <?????> to my daughters a trifle now then I have given to my sons I hope my said sons will not be offended thereat but Will probated their sisters to receive in their house until they can find an <?????>ed give and their <?????> of protection and I give and bequeath unto the said John Hall of one of my executors the sum of £10 for a ring and I do hereby nominate constitute and appoint to the said John Hall and my said sons John Ballard and Thomas Ballard executors of this my will and I do and declare that my said executor and executors shall not be answerable or accountable for any more monies and what shall <?????> to this <?????> hands nor with all for any loss that may happen to my said estate of without his or their wilful neglect or default nor shall the one of them the army trouble or accountable for the acts deeds receipts or defaults of the other of them but only for his own acts and deeds receipts and defaults only and that it shall and may be lawful to and for any said executor and executors and each of them or the survivor of then his executors or administrators out of the monies of my name the receive from time to time to retain end and reimburse themselves all himself or of such costs charges damages and expenses as they or either of them shall or may and sustain expend or be put unto him be due execution of this my will acts of the trusts <?????>ing in the <?????>ing and lastly I do hereby revoke and make void all former and other will and wills by me at anytime heretofore made and do ordain this only to be and containing last will and testament in witness whereof I have to this my said last will and testament contained on three sheets of paper to the to the first sheets and whereof I have set my hand and to this the last my hand and seal this 17th day of November in the year of our Lord 1807 Anne Ballard – signed sealed published and declared by the said testatrix as and for her last will and testament in the presence of us who in her presence and to her request and in the presence of each other have subscribed our names as witnesses thereto – George Hodgson 40 Jermyn Street – Eliza Whereas since making and executing this within written will my daughter Anne has intermarried with Mr Thomas John Richardby Brown I have sufficiently provided leave <?????> <?????> I therefore revoke the bequest give to her of the moiety of my wearing apparel household linen China glass and plate and give the whole thereof unto my daughter Sarah for her own use and benefit. I also revoke and make void the two several legacies of £50 to each of my said daughters having already provided them with the amount of those sums and whereas on the marriage of my said daughter Anne I together with my two sons John and Thomas Ballard entered into a Bond to John Richardby of Lombard Street Banker (a relation of the said Thomas John Richardby Brown) dated the fifteenth day of March 1808 for the payment of the sum of £600 at the end of twelve months next after my decease with interest thereon in the meantime which said sum at once he’s share which my said daughter Anne would have been entitled to on my decease out of the property of her late father and which was advanced by the said John Richard be on her marriage now I do hereby direct my executor and executors to deduct and retain all such interest as I all my said sons shall have paid or may pay on the said Bond Of the share and my said daughter hand and maybe entitled to under my will and pay the same to and amongst my said sons John and Thomas Ballard and my daughter Sarah for their own use and benefit and I do in or other respects ratifying and confirm my said will and declare this acre of the sale thereunto to be approved fairways and to taken as part thereof as witnesses his hand of the within named Anne Ballard the 21st day of May 1810 – Anne Ballard – witness to this signing – George Hodgson – Eliza Hodgson.

 

Proved at London with a codicil ninth September 1816 before of the worshipful Richard Henry <?????> by the oaths of John Hall and Thomas Ballard the son the surviving executors to whom administration was granted being previously sworn duly to administer.
